Article 213 of Kuwaiti Penal Code

There is no offence if the acts provided for in the preceding articles occur in the following circumstances: First: If the published statements or expressions are made by an employee or non-employee in execution of a provision of law or in exercise of a competence or right established by it. Second: If the published statements or expressions amount to no more than a faithful account or summary of what took place at a meeting held, in accordance with the law, by a council, body or committee having a competence recognised by law, or of what took place before a court or during judicial proceedings, provided that no decision prohibiting publication has been issued in accordance with the law. Third: If the statements or expressions were disseminated during judicial proceedings by a person participating in those proceedings, such as a judge, prosecutor, lawyer, witness or party to the case. In the foregoing circumstances, it makes no difference whether the statements or expressions are true or untrue, whether the person making them believes them to be true or not, or whether publication occurred in good faith or bad faith.
