155 Home Page Kuwaiti Penal Code Law No. 16 of 1960 Promulgating the Penal Code and Its Amendments The same penalty specified in the preceding article shall be imposed on anyone who took delivery of, received, possessed, or had transferred to him the debtor's assets, whether by traditional or electronic means, with knowledge of the debt established by the enforceable instrument, with the intention of enabling the debtor thereunder not to discharge it. This provision shall not apply to persons subject to the debtor's guardianship or custodianship. The criminal proceedings shall lapse, at whatever stage they may be, if he delivers the assets to the Enforcement Department or to the investigating authority in preparation for recovery of the debt from the debtor in accordance with the rules governing competing creditors. If the assets are delivered after a final judgment convicting him has been rendered, the court that rendered the judgment may order a stay of execution of the penalty imposed, upon the application of the convicted person. The effect of payment of the debt, settlement, or pardon provided for in the preceding article shall extend to anyone who took delivery of, received, possessed, or had transferred to him the debtor's assets. -
