إذا حكــم على خصــم المعفــى بالرســوم، وجــب مطالبتــه بهــا أولا، فــإن تعــذر تحصيلهــا
منــه جــاز الرجــوع بهــا على المعفــى إذا زالــت حالــة عجــزه طبقــا لــلمادة الســابقة.
