English translation
A procedural act shall be void if the law provides for its nullity, or if it is affected by a material defect resulting in harm to the opposing party. Nullity shall not be adjudged, notwithstanding a provision for it, if the procedural act has not resulted in harm to the opposing party.

يكون الإجراء باطلاً إذا نص القانون على بطلانه، أو إذا شابه عيب جوهري ترتب
عليه ضرر للخصم.
ولا يحكم بالبطلان رغم النص عليه إذا لم يترتب على الإجراء ضرر للخصم.Court of Cassation principles citing this article
