Article 21 of Press and Publications Law

It is prohibited to publish anything that would: 1- Belittle or disparage the Constitution of the State. 2- Insult or belittle members of the judiciary or members of the Public Prosecution, or anything deemed to impugn the integrity and impartiality of the judiciary, or anything that the courts or investigating authorities decide is confidential. 3- Offend public morals or incite violations of the laws and the commission of crimes, even if the crime does not occur. 4- Report on official secret communications and publish agreements and treaties concluded by the Government of Kuwait before their publication in the Official Gazette, except with special permission from the ministry concerned. 5- Affect the value of the national currency, or anything that leads to undermining confidence in the country's economic situation, or news of the bankruptcy of merchants, commercial companies, banks or money changers, except with special permission from the competent court. 6- Disclose what takes place at any meeting or what is written in documents, instruments, decrees or any papers or publications that the Constitution or any law has determined to be confidential or not to be published, even if what is published about them is true; publication shall be limited to the official statements issued in that regard. 7- Infringe upon the dignity of persons, their lives or their religious beliefs, and encourage hatred 1( Item 11 was added by Law No. 17 of 2020 and item 3 was amended by the aforementioned Law or contempt for any segment of society, or publish information about their financial circumstances, or disclose a secret that would harm their reputation, their wealth or their trade name. 8- Infringe upon the private life of an employee or a person entrusted with a public service, or attribute to him untrue statements or acts involving disparagement of his person or abuse of him. 9- Harm relations between Kuwait and other Arab or friendly states if this is done through media campaigns. 10- A specialized newspaper's departure from the purpose of the licence granted to it. 11- Stir up sectarian or tribal strife, or publish ideas advocating the superiority of any race, group, colour, origin, religious denomination, sex or lineage, or incite an act of violence for this purpose.
