Article 2 of Copyright and Related Rights Law

The protection prescribed for copyright and related rights covers Kuwaiti natural and legal persons, foreigners permanently resident in the State of Kuwait, and foreigners who are nationals of a member state of the Convention or the Organisation or who reside in a member state of the Convention. The following shall be deemed to belong to member states: First: With regard to copyright: 1 - Authors who are nationals of a member state of the Convention or the Organisation, in respect of their works, whether published or unpublished. 2 - Authors who are not nationals of a member state, in respect of their works first published in a member state or simultaneously in a non-member state and a member state. A work shall be deemed published simultaneously in several states if it appears in two or more states within thirty days of the date of its first publication. The performance of a dramatic, musical or cinematographic work, the performance of a musical work, the public recitation of a literary work, the transmission by wire or broadcasting of literary or artistic works, the exhibition of an artistic work, and the execution of an architectural work shall not constitute publication. - Producers and authors of audiovisual works whose headquarters or place of residence is in a member state. 4 - Authors of architectural works erected in a member state or other artistic works incorporated into a building or other structure located in a member state. Second: With regard to rights related to copyright: Law Index 533 Home Page Copyright and Related Rights Law Law No. 75 of 2019 Promulgating the Copyright and Related Rights Law 1 - Performers, if any of the following circumstances applies to them: a- The performance takes place in a member state of the Convention or the Organisation. b - The performance is fixed in sound recordings whose producer belongs to a member state of the Convention or the Organisation, or the first recording of the sound is completed in the territory of a member state of the Convention or the Organisation. c - The performance is broadcast through a broadcasting organisation whose headquarters is in a member state of the Convention or the Organisation, using a transmitter also located in a member state of the Convention or the Organisation. 2 - Producers of sound recordings, if the first recording of the sound took place in a member state of the Convention or the Organisation. 3- Broadcasting organisations whose headquarters is in the territory of a member state of the Convention or the Organisation, where the broadcast programme was broadcast from a transmitter also located in the territory of a member state of the Convention or the Organisation. Nationals of member states of the Convention or the Organisation shall enjoy any advantage, preference, privilege or immunity granted by any other law to nationals of any state with regard to copyright and related rights, unless the source of that advantage, preference or immunity is the following: a. Judicial assistance agreements or legal cooperation agreements. b. Agreements concerning copyright and related rights in force before the date on which the World Trade Organisation Agreement entered into force in the State of Kuwait.
