Article 5 of Public Funds Protection Law

The Public Prosecution shall have exclusive competence to investigate, n, dispose of and prosecute the felonies and misdemeanours provided for in this Law and offences connected with them. If the Public Prosecution issues a decision closing the investigation into any of these offences, it must notify the Council of Ministers and the injured entity referred to in Article Two of this Law of the said decision. The Council of Ministers and the injured entity may challenge the closure decision in accordance with the forms and procedures set out in Article 104 bis of Law No. 17 of 1960 on the Criminal Procedure and Trials Code. Under no circumstances may Article 104 of the aforementioned Criminal Procedure and Trials Code be applied to the offences provided for in this Law.
