Article 4 of Environmental Protection Law

The Supreme Council for the Environment shall be formed under the chairmanship of the Prime Minister or the First Deputy Prime Minister, with a number of ministers selected by the Chairman of the Supreme Council as members. The Director General of the Authority shall be a member of the Council and its rapporteur. The Supreme Council shall include among its members three persons possessing experience and competence in the field of environmental protection, whose appointment shall be made by decree for a term of four years renewable for another similar term. The decree appointing them shall determine their remuneration. The Council shall issue internal regulations governing its working procedures and the manner of issuing its decisions. Within the framework of the Government’s general policy, the Council shall take all measures conducive to protecting the territory of the State from pollution, whatever its source, and achieving the objectives stipulated in this Law. It shall also have jurisdiction over the following matters: Formulating the general policy for environmental protection in the State. 2- Approving national environmental protection plans and emergency plans for confronting environmental disasters. 3- Following up on the implementation of the provisions of this Law by all State entities, and resolving any conflict or dispute over jurisdiction that may impede the achievement of the policies, objectives, and items contained therein. 4- Approving the Authority’s annual budget. 5- Selecting two representatives from nongovernmental associations concerned with environmental affairs for membership of the Board of Directors. 6- Approving the internal regulations of the Board of Directors upon the proposal of the Board of Directors. 7- Approving the Authority’s annual work plan and periodic review and evaluation no. 8- Monitoring the environmental situation and working to improve environmental quality and environmental management in the country. 9- Reviewing and approving the annual report on the environmental performance of State institutions and following up on the correction of the shortcomings of State institutions mentioned therein. 10- Approving the financial regulations concerning salaries and wages of employees of the Authority. 11- Approving the organizational structure of the Authority. 12- Endorsing the formation of permanent assisting committees and approving their budgets. 13- Imposing legal sanctions on companies, establishments, and entities violating the provisions of this Law and the environmental requirements and standards contained in its Executive Regulations. 14- Authorizing the ministers concerned with implementing the provisions of this Law and its implementing regulations and decisions, or those authorized by these ministers, to assign the employees necessary to do so and to confer upon them judicial enforcement capacity to establish violations of its provisions in accordance with the provisions of the articles relating to their functions. )1(
