Article 3 of Trial of Ministers Law

Kh An investigation committee shall be formed of three Kuwaiti counsellors of the Court of Appeal, selected by the Court's General Assembly for a term of two years. It shall also select two others as 1( Items f - g were added pursuant to Law No. 29 of 2014, and paragraph - f - was amended pursuant to Decree-Law No. 12 of 2025. 2( The third paragraph is amended pursuant to Law No. 29 of 2014 The Law alternate members to complete the composition of the committee if an original member is absent or prevented from serving. This committee shall have exclusive competence to examine reports submitted in writing and signed to the Public Prosecutor alone, and the report must be referred to the committee within no more than two days. The committee shall confidentially examine the seriousness of the report. Immediately upon receiving it, it must notify the Minister, the Prime Minister and the Speaker of the National Assembly thereof. The Minister may provide the committee with a memorandum containing his observations on the report. The committee may summon the reporting person to hear his statements or take any measure required by this examination. It shall have all powers legally conferred on investigating authorities, except measures affecting the person of the Minister or the inviolability of his home. If it finds the report serious, it shall order that proceedings continue and shall conduct the investigation itself or assign one or more of its members to conduct it. If it finds the report not serious, it shall order it closed. The decision to close it must be reasoned. (1)
