Article 2 of Anti-Corruption Law

The provisions of this Law shall apply to the following categories: 1- The Prime Minister, Deputy Prime Ministers, Ministers and anyone holding an executive position at the rank of Minister. 2- The Speaker, Deputy Speaker and members of the National Assembly. 3- The President and members of the Supreme Judicial Council, the President and counsellors of the Constitutional Court, counsellors of the Court of Cassation and Court of Appeal, judges, members of the Public Prosecution, and the President and members of the Fatwa and Legislation Department. 4- The Director-General and members of each of the General Department of Investigations at the Ministry of Interior and the Legal Department at Kuwait Municipality. 5- Arbitrators and experts at the Ministry of Justice, liquidators, judicial custodians and trustees stipulated in the aforementioned Bankruptcy Law, authenticating officers and notaries in the Real Estate Registration and Authentication Sector at the Ministry of Justice. 6- The President, Vice-President and members of the Municipal Council. 7- The chairpersons and members of councils, authorities and committees undertaking executive functions and whose formation or appointment of members is effected by 1( Replaced pursuant to Decree-Law No. 69 of 2025 a law, decree or decision of the Council of Ministers. 8- The Head of the Financial Controllers Agency, his deputy, the heads of sectors at the Agency and financial controllers. 9- Leadership officials, namely: - Holders of the leadership group of positions in the general salary schedule: excellent grade / undersecretary / assistant undersecretary). - Members of boards of directors, directors-general and their deputies or assistants, and secretaries-general and their deputies or assistants in public authorities or institutions or any governmental body. - Those equivalent to leadership officials among heads of bodies and their deputies, or administrative units, or managing directors in public authorities and institutions. - Department directors and their equivalents among heads of organizational units approved in their structures at department level or higher. - The provisions of the preceding two items shall apply to military personnel, diplomats and civilians in ministries, government departments, public authorities and institutions, and bodies with annexed or independent budgets whenever they undertake the responsibilities or enjoy the benefits prescribed for the position, whether they hold the position substantively or temporarily. - The Authority shall, in coordination with the relevant bodies, periodically identify and update the holders of these positions subject to this Law. 10- The President, Vice-President and members of the Council, the Secretary-General, Assistant Secretaries, directors and technical employees of the Authority. 11- The President, Vice-President, undersecretaries, directors and technical employees of the Audit Bureau. 12- State representatives serving on the boards of directors of companies in which the State or a governmental body, public authority or institution, or other public legal person directly holds a share of no less than 25% of the capital. 13- Members of boards of directors of cooperative societies, their financial and administrative controllers, and sports authorities and clubs. 14- Chairpersons of boards of directors and members of charitable and civil associations, and their executive directors. 15- Members of the Legal Department in each of the Public Institution for Social Security, the Capital Markets Authority, the Insurance Regulatory Unit and the Competition Protection Agency. 16- The Director, Deputy Directors, inspectors, technical employees, members of the Legal Department and everyone vested with judicial enforcement capacity in the General Administration of Customs.
