Article 5 of Anti-Corruption Law

The Authority shall exercise the following functions and powers: 1 - Establishing a comprehensive national strategy for integrity, transparency and combating corruption, preparing the mechanisms, plans and programmes implementing it, and following up on its implementation with the entities concerned. 2 - Detecting, monitoring and tracking corruption offences and recording acts, incidents and violations of financial and administrative corruption; receiving notifications, reports, complaints and information concerning corruption offences and acts, incidents and violations of financial and administrative corruption; taking the necessary measures to conduct inquiries into them; undertaking evidence-gathering activities and hearing statements concerning them and studying them; and taking the legally necessary action to close them or refer them to the competent investigating authority. 3 - Receiving financial disclosure declarations and forming committees to examine them. ‘Ayn 4 - Protecting persons reporting corruption, in coordination with the competent authorities. 5 - Notifying the competent authorities to take the legal measures necessary to rescind any contract to which the State is a party, withdraw a concession, or other such commitments, if it becomes apparent that they were concluded on the basis of a violation of the provisions of the laws or are being performed in violation of the concluded contract, in coordination with the competent authorities. 6 - Following up on the procedures and measures undertaken by the competent authorities to recover funds and proceeds resulting from corruption offences. 7 - Periodically studying legislation and legal instruments relating to combating corruption and proposing the amendments necessary to keep pace with the international conventions and treaties which 1( Item two was replaced pursuant to Decree-Law No. 69 of 2025 the State of Kuwait has ratified or acceded to, developing the measures necessary to prevent corruption, and updating the mechanisms and means of combating it in coordination with all State bodies. 8 - Coordinating with the Ministry of Foreign Affairs in cooperating with Gulf, Arab and international states and organisations concerned with combating corruption, participating in programmes aimed at preventing corruption, and representing Kuwait at regional, Arab and international conferences and forums relating to combating corruption. 9 - Studying and evaluating reports issued by local, regional and international organisations relating to combating corruption, examining Kuwait's position therein, and taking appropriate measures in respect thereof. 10 - Coordinating with the media to raise public awareness and inform society of the dangers of corruption and corrupt practices, their effects, and how to prevent and combat them. 11 - Taking measures to ensure the participation of civil society organisations in making known the dangers of corruption and its effects on society, and expanding society's role in activities opposing and combating corruption. 12 - Requesting the competent authorities to conduct inquiries into incidents of financial and administrative corruption, uncover violations and abuses, and collect evidence relating thereto. 13 - Preparing databases and information systems and exchanging information with entities and organisations concerned with corruption issues domestically and abroad, in accordance with the legislation in force. 14 - Requesting the competent authorities to institute the necessary administrative and civil proceedings. 15 - Referring incidents involving suspicion of a criminal offence to the competent investigating authority, attaching all documents. 16 - Any other functions or powers consistent with the purpose for which the Authority was established and entrusted to it.
