Article 1 of Decree-Law No. 47 of 2026 concerning Combating Terrorist Crimes

In applying the provisions of this Decree-Law, the following words and expressions shall have the meaning indicated opposite each: State: The State of Kuwait. Competent Minister: The minister designated by the Council of Ministers. Terrorist act: Every act or determination leading to a person’s death, detention, or injury, or damage to any national resources, private or public property, public facilities, land, maritime or air transport, or cybersecurity, in execution of an individual or collective criminal enterprise aimed at spreading terror among people, endangering the safety and security of society, or compelling a public authority or a regional or international organization to perform or refrain from performing any act. It also includes acts considered terrorist acts under the relevant legislation in force and as stipulated by international conventions and protocols ratified by the State. Terrorist organization: Every group, body, organization or entity, whatever its legal or actual form, whether inside or outside the State, that aims to carry out a terrorist act. Terrorist: Every natural person who has committed, participated in, or attempted a terrorist act. Terrorist dangerousness: A condition attributed to a person in respect of whom there are grounds to believe that his conduct constitutes a serious threat of committing a terrorist act. Committee: The National Counter-Terrorism Committee provided for in Article (24) of this Decree-Law. - Center: A permanent center called the “Rehabilitation Center”. Law Index 454 Home Page Law on Combating Terrorist Crimes Decree-Law No. 47 of 2026 concerning Combating Terrorist Crimes Rehabilitation program: Reformative activities prepared by the Center, encompassing cognitive, psychological, social, behavioral, health, vocational and religious aspects. Preventive measures: Special procedures comprising the following: a- Police supervision: A preventive measure aimed at monitoring a person’s conduct by requiring him to attend police stations periodically, for the purpose of correcting his conduct under police supervision to ensure that he does not commit terrorist acts or join a terrorist organization. b- Prohibition on frequenting a specified place or places: A preventive measure aimed at prohibiting frequenting or being present in a particular place or geographical area specified by the court. It may be coupled with electronic monitoring to ensure that terrorist acts are not committed or a terrorist organization joined. c- Prohibition on contact with specified persons or entities: A preventive measure aimed at prohibiting contact and communication in any form with persons or entities specified by the court. It may be coupled with electronic monitoring to ensure that he does not commit terrorist acts or join a terrorist organization. Controlled delivery: Allowing objects whose possession constitutes an offense under the law, or which are derived from or used in committing an offense, to pass through or enter the country without seizing them, or replacing them wholly or partially, under the supervision of the competent authorities, with the intention of identifying their final destination, their perpetrators, or their beneficiaries.
