Kuwait Court of Cassation principle number 1163

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A bequest to an indeterminate class is reserved for the needy, with the neediest given priority over the needy. Assessment thereof is left to the executor in a manner that fulfills the purpose of the bequest and accords with the requirements of Sharia, with preference given to those closest to the testator. - The court may supervise the executor's acts and redirect him to what accords with the rules of Sharia and the testator's wishes. Example concerning the judgment's reasonable response to what the appellant raised regarding his authority to dispose of the charitable third of the minors' grandfather's estate.
