State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Conclusion of a valid marriage. Its condition. Offer by the wife’s guardian and acceptance by the husband or their representatives. - The statutory provision being unqualified in identifying who has guardianship to conclude the marriage contract of a virgin between puberty and completion of the twenty-fifth year, or a previously married woman who has reached the twenty-fifth year. Its implication. No basis for restricting it. Construing it as identifying the guardians in marrying a virgin between puberty and the twenty-fifth year. Incorrect. Reason therefor: the legislature did not intend that identification. - The legislature’s intention to specify the guardian. Its implication. This must be expressly stipulated at a particular place in the law. Articles 8, 29, 30 of Law 51/1984 concerning Personal Status.
