Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 445

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Divorce. Neither spouse is believed in denying it after it has occurred. The reason therefor: it creates rights and prohibitions whose observance God has enjoined. Acknowledgment of divorce takes effect judicially, not religiously, even if false. - An acknowledgment is evidence against the person making it. Its implication. It may not be retracted, since there is no denial after acknowledgment.
