Waiver of a minor’s maintenance. Its condition. That it be temporary for a specified period. Otherwise, it is invalid, may not be invoked against the minor, and is deemed nonexistent. The reason thereof. The female custodian’s exceeding the limits of her authority and harming the minors. The judgment’s reliance on a non-temporary waiver. An error in applying the law requiring its cassation.

التنازل عن نفقة الصغير. شرطه. أن يكون مؤقتاً عن مدة معلومة. عدا ذلك. غير صحيح ولا يحاج به الصغير ويعتبر كأن لم يكن. علة ذلك. تجاوز الحاضنة حدود سلطتها والإضرار بالصغار. اعتداد الحكم بالتنازل غير المؤقت. خطأ في تطبيق القانون يوجب تمييزه.Original Arabic judgment citations
