Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 917

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Custody of the child under the Ja'fari school belongs to the mother until he reaches the age of seven unless she marries a stranger, and to the father when he reaches seven or eight years until puberty; it ends upon his reaching puberty with sound judgment, whereupon he has the choice of joining whichever parent or other person he wishes. The judgment's adherence to this and the absence in the papers of grounds for depriving the female custodian of custody. The challenge to it is unfounded.
Arabic original
