Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1470

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A disciplinary decision must rest on a basis justifying it. The administrative authority may not intervene to impose a sanction unless a factual or legal situation exists warranting its intervention. The administrative judiciary may review whether these facts validly exist and whether their legal characterization is correct. The limit thereof: verifying whether the conclusion reached is a tenable inference from grounds that support it factually and legally. If so. The decision conforms to the law and is immune from annulment. Example of a tenable inference, contrary neither to the law nor to what is established in the case papers, that the challenged decision rests on its basis and is immune from annulment.
