Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1556

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court of merits has authority to ascertain and understand the facts of the case, assess the evidence, documents, and defenses, and adopt those it finds convincing. It suffices that it base its judgment on reasonable grounds. It is not obliged to follow the parties through every aspect of their defenses, provided that it states the truth of which it is convinced and sets out its evidence constituting an implicit response defeating all else. Example of a reasonable inference by the judgment and its basis on sound grounds in explaining the appellant’s relationship with the Public Authority for Applied Education and the benefits to which he is entitled by virtue of his work in a general-cadre post.
