Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 169

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Decisions transferring civil servants. They fall outside the jurisdiction of the Administrative Circuit so long as they do not incorporate a decision on a matter within that Circuit's jurisdiction. The reason for this. The administration has discretion to transfer an employee and utilize him in the place it wishes, and the judiciary has no jurisdiction over this decision so long as the procedures do not reveal the administration's intention, through this transfer, to punish the employee without following the prescribed procedures and formalities.
