Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 186

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Everyone born in Kuwait or abroad to a Kuwaiti father is Kuwaiti. Nationality is attached to the fact of birth without the need for a decision to that effect by the administrative authority or any other procedure. Whenever the child's attribution to a Kuwaiti father and his filiation to him are conclusively established. The consequence thereof: his right to obtain a passport, unlike cases of acquiring nationality by a decision of the competent administrative authority granting or withholding it, which have a political character and constitute a form of acts of sovereignty because they are issued by the government in its capacity as a governing authority, not an administrative authority. This case falls outside the jurisdiction of the Administrative Circuit of the Court of First Instance. An example.
