Kuwait Court of Cassation principle number 772

Kuwaitis working for an employer. They must be insured with the Public Institution for Social Security by the employer or by themselves, and the Institution is obliged to fulfill its obligations toward them even if the employer has not registered them or paid contributions on their behalf. The Institution's decision in this regard is merely the implementation and declaration of an individual right that the worker derives directly from the law, such that it acquires no immunity protecting it from annulment, and the Institution may withdraw it if it becomes apparent to it that it contravenes the law.
