English translation of the principle

The administration’s power to amend the contract is the principal characteristic of administrative contracts. Its implication. Its right to amend the contract during its performance whenever the needs of the public service or the public interest so require, without the need for a provision to that effect in the contract or the other party’s consent. Example: Civil Service Council Decision 12/1981 included a provision amending certain appointment contracts in accordance with its provisions upon their renewal. Its effect: the contractual relationship becomes governed by the added provision upon renewal, even if the provision is not actually incorporated in the renewed contract. - Civil Service Council Decision No. 12/1981. Contracts in force from its effective date are subject to the amendment contained therein, even if it is not stipulated in the renewed contract. The reason therefor.
