Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 160

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An investigatory stop does not justify a police officer’s searching the person stopped, even where serious indications exist that he has committed a felony or misdemeanour. He may escort him to the police station and seek the investigator’s permission to conduct the search. The basis for this. Articles 44, 52, Code of Criminal Procedure. - The officer’s merely observing the appellant in an abnormal state or seeing tablets in the car he was driving, without alleging suspicion that their possession or custody was criminalised. Permits an investigatory stop, escorting to the police station, or seeking the competent authority’s permission to search. Does not establish a situation of flagrante delicto permitting arrest and search without authorisation. Nor does it provide strong evidence of his being accused of a felony.
