Kuwait Court of Cassation principle number 1720

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The judge must be allowed freedom when trying the accused. The implication: he is not bound by anything contained in a judgment issued concerning another incident involving the same accused, irrespective of any contradiction between his judgment and the judgment previously issued by another judge. - The appellant’s contention that he had previously been acquitted in other similar incidents. Has no place.
