Kuwait Court of Cassation principle number 1789

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The mere restriction of the appellant’s liberty and his presence in prison. Is not an excuse preventing the lodging of an appeal within the time limit. The reason for this. - 489 - Criminal Procedures and Trials - The prison administration is not obliged to provide the convicted person with an appeal petition form on its own initiative unless he expresses his wish to appeal. - The court’s right not to believe the accused’s defence unsupported by evidence. - The appellant’s reliance on the excuse of illness which prevented him from lodging an appeal within the time limit. Is refuted by his lodging the present appeal during the period of the alleged illness.
