Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1797

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The appeal petition. May not be supplemented by anything external to it. - The Public Prosecution’s appeal against the first-instance judgment on grounds of proof. Its implication: it challenges the acquittal ordered by that judgment. The appellate court’s consideration of accused persons who were convicted. Impermissible. This is not altered by the Public Prosecution’s endorsement on the case file conveying something contrary to the appeal petition, or by a clerical error in the preamble of the challenged judgment including the name of a convicted person among the respondents, provided that its grounds make clear that the Public Prosecution’s appeal on grounds of proof concerns those acquitted. The Public Prosecution’s appeal against this judgment must be ruled impermissible.
