Deeming an absent appellant to have abandoned his appeal, requiring a ruling deeming his appeal never to have existed. When this is valid: upon ascertaining that he was validly served with notice of the hearing set to hear his appeal. - Effecting service according to a specific form. Not necessary. - Personal service upon the accused of notice of the hearing set to hear his appeal, by means of a list sent to the administration of the prison in which he is detained. Valid. His failure, despite this, to attend the hearing and the ruling deeming his appeal never to have existed. The allegation that the judgment is invalid because of procedural invalidity. Incorrect.
