Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 731

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court's obligation to set out the evidence on which it relies in its judgment and state its substance adequately. Mere reference to it. Insufficient. Failure to do so vitiates the judgment for inadequate reasoning. An example of a judgment that relied upon a forensic medical report without setting out its substance, merely referring to it.
