Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 751

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Medical reports in themselves do not constitute evidence against the accused. Import of that: they are not vitiated by not being based on certainty. The court's adoption of probabilistic evidence. Permissible. Condition for that: that the conviction be founded on certainty. An example concerning the court's reaching a definitive conclusion on what the forensic medical report did not definitively establish in an intentional homicide offense.
Arabic original
