State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Medical reports in themselves. Do not constitute evidence against the accused. They are not vitiated if not based on certainty. - The judgment's adoption of probabilistic evidence. Does not impugn it so long as it founded the conviction on certainty. - Challenging the appealed judgment on the ground that the forensic medical report did not definitively establish that the victim's injuries were sustained at a time contemporaneous with the incident and resulted from it. Does not vitiate it. So long as the trial court reached a definitive conclusion on what the expert did not definitively establish in his report. Limit of that.
