State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The appellate court's Registry must serve the accused and the other parties with notice of the hearing scheduled for the appeal and ascertain, before the court determines the action in the accused's absence, that he has been validly served to attend the scheduled hearing. - Delivery of the notice addressed to an imprisoned accused shall be to the prison director or whoever acts in his place. - Proof that the notice addressed to the imprisoned accused was delivered to the Public Prosecution because he could not be located. Effect: he was not validly served. The appellate court must adjourn his trial to a subsequent hearing of which he is to be notified. Omission thereof and adjudication of the appeal brought by the Public Prosecution on the basis of that service. Vitiates the judgment and requires its cassation.
