Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 996

State of Kuwait · Criminal Procedure · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The appellant's failure to renew his request to hear defense witnesses or conduct an investigation before the appellate court, or to maintain it in his final requests. It is deemed a waiver thereof. The reason therefor: the Court of Appeal, as a rule, adjudicates on the basis of the papers and hears only such witnesses as it considers necessary to hear. Its implication: its failure to hear the defense witnesses signifies that it saw no need to hear them.
