Kuwait Court of Cassation principle number 112

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Exemption of the offender from punishment for loss of understanding and freedom of choice at the time of committing the act. Its criterion: it must be attributable to mental illness or mental infirmity and nothing else. Article 22 of the Penal Code. - The female appellant’s contention that she committed her offence under the influence of suffering from a psychological condition resulting from an unknown person having sexual intercourse with her, her becoming pregnant by him out of wedlock, and the disgrace that befell her. Does not establish the defence of absence of criminal responsibility due to mental illness. The judgment’s omission of this manifestly invalid defence. Does not vitiate it. The female appellant’s objection in this regard. Incorrect.
