Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1166

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Determining the existence or absence of intent to traffic in narcotics. A question of fact which the trial judge independently decides without review, so long as he bases it on what supports it. - The accused's sale of the narcotic heroin to the confidential source for a sum of money and the accused's admission of possessing the narcotic with intent to act as an intermediary in its sale. Sufficient to establish intent to traffic on his part. The failure to seize in his possession tools ordinarily used in drug trafficking, or the absence of proof of prior activity by him in this field. Does not detract from this.
