Kuwait Court of Cassation principle number 1409

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Mitigating circumstances generally affect only principal penalties, not accessory or supplementary penalties, including dismissal, restitution and proportional fines. This means: abstention from pronouncing punishment is impermissible in respect of these penalties. Example: establishment of the offence of misappropriation against a public official. Abstention from pronouncing punishment in respect of the principal penalty while imposing dismissal without restitution. No error.
