Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1644

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Deciding to refrain from pronouncing punishment. Its cases. The trial judge must adhere to them, and this must lead rationally and logically to the belief that the accused will not return to criminal conduct. - 426 - Criminal Law - The judgment's reliance, in ruling to refrain from pronouncing punishment, on the accused's past being free of convictions, contrary to what is established in his record of convictions attached to the case file. This vitiates it by defective inference, in addition to contradicting what is established in the papers, necessitating its cassation.
