Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1679

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The penalty prescribed for possessing and holding narcotics with intent to use is imprisonment for a term not exceeding five years and a fine not exceeding five thousand dinars. Sentencing the appellant to imprisonment for two years and a fine of five hundred dinars falls within the limits of the penalty prescribed for this offence. The objection that he should have been punished with a fine rather than imprisonment. Unsound.
