Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1729

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Appeal in cassation. Confined to judgments issued by the Court of Appeal in felony matters and ancillary civil actions, to the exclusion of those issued in misdemeanour matters and ancillary civil actions. - Appeal in cassation by the civil claimants in the civil action brought ancillary to the criminal action concerning two misdemeanour offences. Impermissible. This is not altered by the occurrence of the word felony in the context of a phrase contained in the indictment. The challenged judgment’s reproducing that phrase as it stands and acquitting the respondents. A clerical error that does not alter the reality of the case. The reason therefor.
