Kuwait Court of Cassation principle number 1736

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The rule is that civil-rights actions are brought before the civil courts. The exception is bringing them before the criminal court where they are ancillary to the criminal action and the right claimed arises directly from a wrongful act constituting an offense that is the subject of the pending criminal action. - What is required for an acquittal. The trial court’s doubt as to the correctness of attributing the charge to the accused. - 447 - Criminal - Contradiction that vitiates a judgment. Its nature. - The court’s acquittal because the charge against the appellant was not established. Requires dismissal of the compensation claim. Reason therefor: compensation has no basis. - Independence of the fault for which compensation is sought from the criminal fault constituting the offense. The forum for claiming compensation for the first fault is the competent civil court, not the criminal court hearing the civil action founded on the fault constituting the offense.
