Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 343

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The offence of using influence. Its two forms: requesting a promise or gift on the pretext that it is a bribe for a public official, intending to retain it. Or to use actual or alleged influence to obtain or attempt to obtain an advantage from a public authority. - The claim of influence. It need not be explicit. - Invoking influence. It does not require the use of fraudulent means. Mere lying establishes the claim. The existence of both matters establishes the offence of fraud alongside influence peddling.
Arabic original
