Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 416

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The felony of intentional killing is distinguished from other offences against the person by a special element, namely the offender's intent, in committing the act, to take the victim's life, which is a matter concealed by the offender and harboured within himself. A judgment convicting the accused of this felony must take care to discuss this element separately and demonstrate it by setting out the evidence from which the intent to take the victim's life at the time of committing the material act was inferred. The rationale thereof. An example of defective reasoning concerning the existence of intent to kill. - The accused's preparation of a pistol, firing it at the female victim from close range, and causing her injury. Insufficient to establish intent to kill so long as the judgment does not disclose the existence of that intention within him. The rationale thereof. - Cassation of the judgment in respect of one of the charges brought against the accused. Requires its cassation in respect of the other charges connected with it.
