Prescription of the Government's right to recover amounts paid to an employee without entitlement. Its period. Five years from the date of disbursement. This prescription is limited to amounts paid without legal entitlement. It does not extend to amounts initially paid rightfully but subsequently held by the employee without entitlement because the basis for disbursement ceased to exist. A judgment applying prescription without establishing whether the amounts were disbursed rightfully or wrongfully. A deficiency requiring its cassation.
