Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1374

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Definition of mental deficiency under Article 945 of the Majalla and the statements of jurists. Assessing the existence of mental deficiency is a matter for the trial court. The disposition of a mentally deficient person is like that of a discerning minor; authorization is not given by anyone other than the guardian. The Majalla does not require that mental deficiency be notorious before registration of the interdiction decision or that the other contracting party know of it.
