State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Dispositions involving both benefit and detriment. What is meant by them. Example. - A person of diminished capacity invoking his diminished capacity. His having claimed to possess capacity does not preclude this. - A minor's resort, in order to conceal his capacity, to fraudulent methods capable of concealing his diminished capacity. His obligation to compensate the person who contracted with him for the harm resulting from avoidance of the contract. The distinction between a minor and a person of diminished capacity in this regard. The trick used by a minor to conceal his age can deceive an ordinary person, whereas, for persons of diminished capacity other than minors, such as the prodigal and the heedless, it is difficult for it to deceive an ordinary person.
