Fraudulent misrepresentation. Its nature. - Lying and concealment. Treating them as deception. Its condition. They must breach a special duty of truthfulness or candour which the circumstances entitle the deceived person to place in the person who misled him. Its import. This can occur only through breach of a distinct special duty from which the person must refrain. - Mere lying. Does not constitute a sufficient basis for fraudulent misrepresentation invalidating a contract.
