Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2312

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A sale contract. The purchaser’s right to retain the sold property after its dissolution until the seller repays him the price paid. The reason therefor: his obligation to deliver corresponds to the seller’s obligation to refund the price received. The purchaser’s right of retention is extinguished by the seller’s performance of his obligation. In a sale of another’s property, this right exists against the seller of another’s property, not against the true owner. Contravention of that. An error requiring cassation of the judgment.
