Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 234

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments issued by the court of first instance as final judgments. The general rule is that they may not be appealed unless the law provides otherwise, or they contradict an earlier judgment that has not acquired the force of res judicata, or are vitiated by nullity, or are based on void procedures. - The Court of First Instance's final jurisdictional monetary limit. Its amendment to 5,000 dinars instead of 1,000 dinars. The amendment encompasses all disputes, including labour disputes. Its immediate application to judgments issued after its entry into force. The reason is that a judgment's amenability to challenge is governed by the law in force at the time of its issuance.
