Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 245

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Where a provision is general and explicit in indicating its intended meaning, there is no room to restrict or interpret it on the pretext of seeking guidance from the legislator's intent. - The judgment's restriction of the wife's consent precluding her entitlement to consolatory compensation, which was expressed in general and unrestricted terms, to her consent to divorce expressed before the authenticating official. A restriction by the judgment of an unrestricted provision and a particularization of its generality without a particularizing basis; it has no res judicata effect when examining other evidence of the wife's consent to divorce.
