State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A special law may not be disregarded in order to apply the general law except as regards provisions omitted from the special law. The reason: the special law is an exception to the general law, limiting the generality of its provisions by restricting or repealing them solely in respect of what it specifically regulates. The effect thereof: each applies within its own scope. The special law applies to what is specifically assigned to it, and the general law to what remains within its purview. - Enactment of a special law excluding what was provided in the previous special law. Its consequence. The legislature has left the matter to the provisions of the general law. The reason: absence of conflict between the provisions of the two laws.
